Jumpo AI Camera – Terms of Service

1. Introduction

These Terms of Service (“Terms”) apply to the Jumpo AI Camera device, the parent platform (mobile app or web dashboard), and the official website www.jumpo.ai, operated by Azores Labs, Inc. (“we,” “our,” or “us”).

By registering an account, binding a device, or using any part of the Service, you agree to be bound by these Terms. Parents or legal guardians must be at least 18 years old and may act on behalf of their child users.

2. Account Registration and Parental Responsibility

To activate a Jumpo AI Camera, a parent must create a parent account, bind the device, and complete credit-card verification. Credit-card verification is required to authenticate that the account holder is an adult and to initiate the 60-day free trial of the Paid plan. Parents may cancel at any time before the trial ends to avoid charges.

Parents are responsible for managing their account credentials, monitoring device use, and ensuring safe and age-appropriate interactions. Children cannot access or register on the parent platform independently. Parents may manage or delete accounts and associated data at any time.

3. Use of the Device and App

The Jumpo AI Camera and app are designed for educational and entertainment purposes only. You may not use the Service for any unlawful or harmful activities.

Photos and voice data captured by the device are stored locally by default and securely synchronized with the parent dashboard to allow review and management.

Reverse engineering, modifying, reselling, or distributing the software or hardware is prohibited. Users may not upload or share inappropriate or unlawful content.

4. Subscription and Paid Services

4.1 Subscription Structure (Paid vs Free)

The Service offers two tiers:

  • Paid Plan
    Paid subscribers have access to:
    • AI features
    • Unlimited eSIM connectivity
    • Cloud uploads
    • Cloud storage with a 30-day retention period
  • Free Plan
    Free users may:
    • Take photos locally on the device
    • Use Wi-Fi for basic connectivity
    • Upload photos to the cloud
    • Use cloud storage with a 30-day retention period
    Free users do not have access to AI features or eSIM connectivity.

4.2 Activation and Free Trial

When activating a new device, parents must enter a valid credit card. A 60-day free trial of the Paid plan begins automatically.
If not canceled before the trial ends, the subscription will automatically renew at $5.99 per month.

4.3 Billing and Auto-Renewal

Parents can view billing details, update payment methods, or cancel at any time via the Parent Dashboard.
We provide clear disclosures at enrollment in compliance with applicable laws, including the FTC’s Negative Option Rule and the California Automatic Renewal Law.

Subscription charges are non-refundable once processed unless required by law.

5. Ownership and Intellectual Property

All software, AI models, design, and interfaces are owned by Azores Labs, and protected under intellectual property laws.

You retain ownership of photos, videos, and recordings captured using your device. By using the Service, you grant us a limited license to process and store this content solely for the purpose of securely synchronizing it with the parent dashboard for parental review and management.

6. Privacy and Data Protection

We are committed to protecting your privacy and your child’s data.

Parents control how their child’s photos and media are stored, may delete media at any time, and may delete their account to clear all cloud-stored data.
All data practices, including parental consent verification via credit card, are described in our Privacy Policy, which forms part of these Terms.

7. Firmware and Software Updates

We may automatically download and install software or firmware updates to enhance performance and security.
By using the device, you agree to receive such updates, which may modify or remove certain features.

8. Safety Disclaimer

The Jumpo AI Camera is an educational tool, not a toy for unsupervised use. It is not designed for medical, diagnostic, or safety monitoring purposes. Keep cords and small parts away from children under 3 years old.

9. Limitation of Liability

Azores Labs and its suppliers are not liable for:
(A) losses caused by misuse, network failure, or third-party services; or
(B) indirect, incidental, special, consequential, or punitive damages.

We are not responsible for errors in AI-generated content or speech recognition.
In all cases, our total liability shall not exceed the amount you paid for the product or service.

10. Warranty Disclaimer

Except for any warranties explicitly provided in a separate hardware guarantee, the Jumpo AI Camera and associated services are provided without any promises or guarantees regarding performance, reliability, or suitability. To the maximum extent allowed by law, we make no warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Binding Arbitration and Class Action Waiver

11.1 Arbitration

If you are located in the United States, any dispute arising from these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in California, unless both parties agree otherwise.

11.2 Class Action Waiver

All claims must be brought individually and not as a class, collective, or representative action.

11.3 Opt-Out

You may opt out of this arbitration clause by sending written notice to our support email within 30 days after first agreeing to these Terms.

12. Account Termination

Parents may delete their account at any time. Deleting the account will terminate cloud services and permanently remove all related cloud data, while local camera data remains intact.

We reserve the right to suspend or terminate an account that violates these Terms.

13. Updates and Modifications

We may update these Terms from time to time. Updates will be communicated via the app, our official website, or by email. Continued use of the Service after the effective date of such updates constitutes your acceptance of the revised Terms.

14. Governing Law and Contact

These Terms are governed by the laws of California, USA, without regard to conflict-of-law principles.
